I. DEFINITIONS
In this "Privacy Policy," the following terms shall have the meanings set forth below:

"Kler" - Kler S.A. with its registered office in Dobrodzien, ul. Piastowska 39B, 46-380 Dobrodzień, entered into the National Court Register under the KRS number 0000056597, whose registration files are kept by the District Court for the city of Opole, VIII Economic Department; share capital in the amount of: PLN 51,668,360.00, fully paid; Tax Identification Number (NIP): 575-00-07-865; National Official Business Register Number (REGON): 150854711; email: [email protected], tel. +48 34 35 29 100,

"Service" - the internet service located at the website www.kler.eu and its subpages,

"User" - every internet user visiting the pages of the Service.


II. PRELIMINARY PROVISIONS

§ 1
 Terms written in capital letters have the meanings assigned to them in the "Definitions" section.

§ 2
 Based on Article 20(1) of the Act of July 18, 2002, on the provision of electronic services and pursuant to REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation - GDPR), Kler introduces this Privacy Policy referred to hereinafter as the "Policy".


III. PERSONAL DATA
§ 3

In order to use the newsletter service, communicate with the salon via the contact form, and purchase cleaning products offered by Kler through the Service, the User must fill out the appropriate form. Certain personal data must be provided therein.

Providing personal data in the form is voluntary but necessary for Kler to provide services to the User through the Service.

Any personal data that the User enters into the contact form, purchase form for cleaning products, or provides in correspondence with Kler, is processed in accordance with the requirements set forth in Polish law, particularly REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation - GDPR).

§ 4

The administrator of personal data is Kler. Kler may entrust the processing of collected personal data of Users to another entity based on a data processing agreement concluded with them.
The entrusted data will be:
to companies providing postal or courier services, which will deliver cleaning products purchased on the Service to the User, for the purpose of executing the sale of products through the Service,
to companies providing newsletter delivery services, for the purpose of delivering newsletters to users' email addresses,
to companies providing hosting services for Kler,
to companies providing service administration for the Service.

§ 5

The User has the right to access their personal data, to correct, delete, or limit processing, or to object to processing, as well as the right to data portability, by submitting the appropriate request to Kler. The request can be submitted:

 Additionally, the User has the right to withdraw consent at any time and the right to lodge a complaint with the supervisory authority.

§ 6

Kler processes personal data of Users and uses it to the extent and for the purpose necessary to provide services offered through the Service, including providing the newsletter delivery service, selling cleaning products, and responding to messages sent via the form by Users.
Based on additional and optional consent, which the User may express in a separate statement, Kler has the right to contact and send newsletters to the email addresses or phone numbers provided by them, including information about new products, promotional actions, or cultural events sponsored by Kler. If the User gives such consent, they may withdraw it at any time.

§ 7

Personal data collected by Kler may be disclosed to authorized state authorities based on applicable law.

§ 8

Kler implements technical measures required by current personal data protection regulations to prevent unauthorized acquisition and modification of personal data transmitted electronically.

§ 9

The User does not have the option to use services provided through the Service anonymously or under a pseudonym.

§ 10

Kler may record the User's IP address from which they access the Service.

IV. COOKIES
§ 11

The Service uses cookies (so-called "cookies"), which are small text information stored on the User's device that can be subsequently read by Kler.

Cookies are used for the following purposes:

adapting the content of the Service to the User's preferences and optimizing the use of the Service; in particular, these files allow recognizing the User's device and displaying the website accordingly, tailored to their individual needs;
creating statistics to understand how Users interact with websites, which allows for improving their structure and content;
maintaining the User's session, so that the User does not have to re-enter their login and password on each subpage of the Service;
adapting the content of the newsletter to the User's preferences;
detecting abuses in the authentication process on the Service;
marketing purposes.
Within the Service, two main types of cookies are used: "session" cookies and "persistent" cookies. "Session" cookies are temporary files stored on the User's device until logging out, leaving the website, or closing the web browser. "Persistent" cookies are stored on the User's device for the time specified in the parameters of the cookies or until they are deleted by the User.

Kler also informs Users that it is possible to configure the web browser to prevent the storage of cookies on the device. Kler also indicates that cookies may be deleted by the User after they are saved by Kler, through: appropriate functions of the web browser, programs intended for this purpose, or by using appropriate tools available within the User's operating system.

§ 13

Kler also informs Users that changing the configuration of the web browser to prevent or limit the storage of cookies on the User's device may result in limitations of the functionality of the provided services. Deleting cookies during the provision of the service may lead to similar effects. This may result in the inability to log into the Service or the interruption of the session after logging in.

§ 14

Cookies placed on the User's device may also be used by third-party entities cooperating with Kler.

§ 15

Kler also uses tracking code based on cookie technology, allowing for monitoring the User's activity on the Service's website and recording individual User sessions to analyze User behavior on the Service and create behavior maps. This allows understanding how Users use the Service, identifying problems with its use.
